On 3 April 2009, the President of the Human Rights Council established the United Nations Fact Finding Mission on the Gaza Confilct with the mandate "to investigate all violations of international human rights law and international humanitarian law that might have been committed at any time in the context of the military operations that were conducted in Gaza during the period from 27 December 2008 and 18 January 2009, whether befroe, during or after"

Richard Goldstone visited the Gaza City neighborhood of Zaytoun in late June to tour the compound of the extended Samouni family. Twenty-nine members of the family, all of them civilians, were killed in the Israel Defense Force's winter assault - 21 during the shelling of a house where IDF soldiers had gathered some 100 members of the family a day earlier.

"The Obama administration joined our recommendation calling for full and good-faith investigations, both in Israel and in Gaza, but said that the report was flawed," Goldstone told Al Jazeera.

The commission chair said that once Washington points out the flaws, he would be ready to respond. "I have yet to hear from the Obama administration what the flaws in the report that they have identified are. I would be happy to respond to them, if and when I know what they are," he said.

The remarks follow a U.S. opposition to a UN Human Rights Council resolution on the report in Geneva.

Russia and China are also among those who voted against a discussion of the Goldstone probe in the Security Council. The report passed by 25 votes to six, 11 countries abstained, and five countries did not vote, among them Britain and France.

The House of Representatives passed a resolution condemning the Goldstone Report, which had found the Jewish state complicit in war crimes, while just last month, in his speech before the U.N General Assembly, President Obama vowed “unshakeable opposition� to any efforts to “chip away at Israel’s legitimacy.�

The recent decision of the US Congress to repudiate (HR 867) the findings of Israeli war crimes in the official Final Report of the United Nations’ Fact Finding Mission on the 2009 Gaza Conflict by a vote of 344 – 36 is a measure of the power of the Zionist Power Configuration (ZPC). "The key to the power of the Zionist Power Configuration is that it is a mass grassroots organization, bolstered by the financial support by scores of millionaires and dozens of billionaires and a complicit mass media. These political resources translate into tremendous leverage over the far more numerous non-Zionist electorates, the mass media spectators and the upwardly mobile politicians."

The ZPC is powerful but not omnipotent. It controls the US Congress and Executive and has decisive influence in the mass media, but there are important fissures in the monolith, as a number of Jewish organizations and individuals, revolted by Israel’s mass killings in Gaza and the ZPC unconditional support, have spoken out in support of the Goldstone Report.

More importantly, major national trade/union federations in Canada, Ireland, Great Britain, France and Italy, along with numerous human rights organizations, support a global boycott and disinvestment campaign against Israeli products. Judicial processes are proceeding in various European countries to arrest and put on trial top Israeli officials involved in the Gaza massacre.

The report, also known as the “Goldstone Reportâ€?, after its principle author Justice Richard Goldstone, was released on September 15, 2009, amid a carefully orchestrated campaign to discredit its findings and its authors. The 51 Presidents of the Major American Jewish Organization (PMAJO) claim to speak for all Jews in the US. What is even more important than the US Congressional vote of condemnation is the fact that the campaign was publically ordered from Israel, directed by the Presidents of the ‘51’ and obediently and enthusiastically carried out by several hundred thousand Zionist activists, throughout the country. The ‘51’ and the mass of Zionist zealots were openly defending Israeli state terror and crimes against humanity. Their defense of war crimes never evoked a second thought. What mattered was their ability to pressure, threaten, cajole and promise future funds to Congressional representatives in order to secure their vote against Justice Goldstone. Blind obedience to Israeli dictates was evident in the fact that many Congresspersons proudly confessed to never having even read the Goldstone Report and that none dared question the egregious fabrications, which its two uber-Zionist Congressional sponsors, (Representatives H.L. Berman, D-California and G.L. Ackermann, D-New York), of the House Resolution 867, concocted. The US Congress, in fact, almost unanimously rejected the eminent Justice Goldstone’s request to present his findings in person.

In the UN National Assembly, the Zionists were able to leverage the US to vote against the Goldstone Report, which in turn secured the vote of several Eastern European client states, insignificant island dependencies and the predictable Western European “Allies�. This amounted to a total of 18 votes against the 114 UN members who endorsed the Report’s thorough documentation of Israeli war crimes and state terrorism, an endorsement which represented over 80% of the world’s population.

My mission - and motivation

Five weeks after the release of the Report of the Fact Finding Mission on Gaza, there has been no attempt by any of its critics to come to grips with its substance. It has been fulsomely approved by those whose interests it is thought to serve and rejected by those of the opposite view. Those who attack it do so too often by making personal attacks on its authors' motives and those who approve it rely on its authors' reputations. Israeli government spokesmen and those who support them have attacked it in the harshest terms and, in particular my participation, in a most personal and hurtful way. The time has now come for more sober reflection on what the report means and appropriate Israeli reactions to it. I begin with my own motivation, as a Jew who has supported Israel and its people all my life, for having agreed to head the Gaza mission. Over the past 20 years, I have investigated serious violations of international law in my own country, South Africa, in the former Yugoslavia, in Rwanda and the alleged fraud and theft by governments and political leaders in a number of countries in connection with the United Nations Iraq Oil for Food program. In all of these, allegations reached the highest political echelons. In every instance, I spoke out strongly in favor of full investigations and, where appropriate, criminal prosecutions. I have spoken out over the years on behalf of the International Bar Association against human rights violations in many countries, including Sri Lanka, China, Russia, Iran, Zimbabwe and Pakistan. I would have been acting against those principles and my own convictions and conscience if I had refused a request from the United Nations to investigate serious allegations of war crimes against both Israel and Hamas in the context of Operation Cast Lead.

AS A Jew, I felt a greater and not a lesser obligation to do so. It is well documented that as a condition of my participation I insisted upon and received an evenhanded mandate to investigate all sides and that is what we sought to do.

I sincerely believed that because of my own record and the terms of the mission's mandate we would receive the cooperation of the Israeli government. Its refusal to cooperate was a grave error. My plea for cooperation was repeated before and during the investigation and it sits, plain as day, in the appendices of the Gaza report for those who actually bother to read it. Our mission obviously could only consider and report on what it saw, heard and read. If the government of Israel failed to bring facts and analyses to our attention, we cannot fairly be blamed for the consequences. Those who feel that our report failed to give adequate attention to specific incidents or issues should be asking the Israeli government why it failed to argue its cause.

Israel missed a golden opportunity to actually have a fair hearing from a UN-sponsored inquiry. Of course, I was aware of and have frequently spoken out against the unfair and exceptional treatment of Israel by the UN and especially by the Human Rights Council.

I did so again last week. Israel could have seized the opportunity provided by the even-handed mandate of our mission and used it as a precedent for a new direction by the United Nations in the Middle East. Instead, we were shut out.

As I stated in response to a recent letter from the mayor of Sderot, I believed strongly that our mission should have been allowed to visit Sderot and other parts of southern Israel that have been at the receiving end of unlawful attacks by many thousands of rockets and mortars fired at civilian targets by Hamas and other armed groups in Gaza. We were prevented from doing so by, what I believe, was a misguided decision by the Israeli government.

In Gaza, I was surprised and shocked by the destruction and misery there. I had not expected it. I did not anticipate that the IDF would have targeted civilians and civilian objects. I did not anticipate seeing the vast destruction of the economic infrastructure of Gaza including its agricultural lands, industrial factories, water supply and sanitation works. These are not military targets. I have not heard or read any government justification for this destruction.

OF COURSE the children of Sderot and the children of Gaza have the same rights to protection under international law and that is why, notwithstanding the decision of the government of Israel, we took whatever steps were open to us to obtain information from victims and experts in southern Israel about the effects on their lives of sustained rocket and mortar attacks over a period of years. It was on the strength of those investigations that we held those attacks to constitute serious war crimes and possibly crimes against humanity.

The refusal of cooperation by the government of Israel did not prevent us from reacting positively to a request from Gilad Schalit's father to speak personally to our mission at its public session in Geneva. No one who heard his evidence could fail to have been moved by the unspeakable pain of a parent whose young son was being held for over three years in unlawful circumstances without any contact with the outside world and not even allowed visits from the International Committee of the Red Cross. The mission called for his release.

Israel and its courts have always recognized that they are bound by norms of international law that it has formally ratified or that have become binding as customary international law upon all nations. The fact that the United Nations and too many members of the international community have unfairly singled out Israel for condemnation and failed to investigate horrible human rights violations in other countries cannot make Israel immune from the very standards it has accepted as binding upon it.

Israel has a strong history of investigating allegations made against its own officials reaching to the highest levels of government: the inquiries into the Yom Kippur War, Sabra and Shatila, Bus 300 and the Second Lebanon War.

Israel has an internationally renowned and respected judiciary that should be envy of many other countries in the region. It has the means and ability to investigate itself. Has it the will?

Nuke Gaza: A World Gone Mad

October 27, 2009 "VeteransToday" -- - Israeli officials are right to worry. Gazans too. Yet Americans should worry even more. Israel’s “legitimacy� will not last.

Of course, that assumes its legitimacy was deserved. That issue also is now called into question in light of the consistency of Israeli behavior over the past six decades. The emerging issues are these: When and how will the recognition of Israel’s nation-state status be withdrawn? How will Tel Aviv behave in the interim?

Israeli Foreign Minister Avigdor Lieberman may have tipped his Masada hand when he reportedly told Turkish Prime Minister Tayyip Erdogan that Israel may use nuclear weapons against Gaza. The threat to Israel is not the 1.5 million Gazans who reside in the world’s largest open-air prison. The threat is the fast-growing global outrage at the abuse inflicted on Palestinians, commencing with the ethnic cleansing of 400-plus villages six decades ago.

Not since 1948 has this enclave of extremists mounted such a public relations offensive. Christian Zionist President Harry Truman trusted Jewish Zionist lobbyists when he solicited assurances that they would not become what they immediately became: a racist theocratic state with an expansionist agenda destined to create serial crises in the region.The merciless global agenda pursued by Colonial Zionists is the single greatest threat to world peace, as confirmed yet again by Lieberman’s warning. As the primary remaining ally of these Jewish nationalists, the risks to the U.S. increase with each passing day as Tel Aviv works behind the scenes to catalyze yet another conflict. This entangled alliance was destined to provoke resentments that would eventually endanger their super power ally and foremost arms provider. Khaled Sheikh Mohammed, the confessed mastermind of the mass murder of 9-11, conceded that the motivation for that attack was to focus “the American people…on the atrocities that America is committing by supporting Israel against the Palestinian people and America’s self-serving foreign policy that corrupts Arab governments and leads to further exploitation of the Arab Muslim people.

�The Joint Chiefs of Staff warned Truman 61 years ago that this militant enclave meant to establish Jewish military and economic hegemony over the entire Middle East. Familiar with the duplicity for which Israel has since become infamous, the Pentagon chiefs warned:

“All stages of this program are equally sacred to the fanatical concepts of the Jewish leaders.� Nuclear-Armed Fanatics

With each passing year, Tel Aviv adds a new chapter to the agent provocateur handbook on How To Succeed as a Victim. Israel’s strategic success traces directly to its capacity to radicalize and enrage—as those residing in the Occupied Territories endure a third generation of deprivation, degradation and periodic starvation.

Thus the in-depth planning that preceded Israel’s brutal “defensive� assault on Gaza between Christmas 2008 and the inauguration of Barack Obama—who said nothing about the attack throughout its 28-day duration. That silence continues even now after Richard Goldstone, a South African jurist, issued a report describing dozens of Israeli war crimes and evidence of crimes against humanity.

In the lead-up to the report’s release, a U.S. president gave Tel Aviv a rhetorical gift when, in a U.N. speech, the nation’s first Black president used the code phrase “Jewish state� as an implied endorsement of the apartheid policies of this racist enclave.

Even Truman did not go that far. But then his administration was not as thoroughly staffed with Zionists and pro-Israelis. In addition to killing some 1400 Palestinians, one-third of them women and children, Israel destroyed the infrastructure of Gaza including farmlands, factories and schools as well as its water supply and sanitation works.

The facts in the Goldstone Report were further confirmed by “Breaking the Silence�—the personal testimony by thirty members of the Israel Defense Forces who described a murderous policy meant to teach the people of Gaza a lesson for their support of Hamas—which came to power in 2006 elections that were universally appraised as free and fair.

As Israel’s protector and apologist, the U.S. bears the brunt of the anger as Israeli extremism continues to enrage Muslims and radicalize the Islamic body politic.

A systematic assassination campaign ensured that Tel Aviv had “no one to talk to� except known collaborators with the occupation authorities in Tel Aviv and their arms suppliers in Washington.

Meanwhile, the steady expansion of Israeli settlements made a Palestinian state impossible—unless indigenous Arabs are happy to reside in an archipelago of isolated ghettos ringed by Israeli checkpoints. To suggest that the U.S. is culpable only states the obvious.

Yet Israeli extremism continues unabated even as Tel Aviv insists that its neighbors accept it as a “Jewish state� even before its borders are fixed and resolution of the occupied territories is known. After six decades of nonstop deceit, Arab states are understandably reluctant to further appease this “state.�

For Americans endangered by the behavior of Jewish fanatics, the lesson is uncomfortable but inescapable: we enabled this. By our continued appeasement, Barack Obama is inviting another violent reaction to Israel’s serial provocations. By failing to endorse the Goldstone Report, our commander-in-chief is putting U.S. forces at risk.

By implying that Israel is above the law, he only emboldens Tel Aviv. By suggesting that Israeli conduct is consistent with the values of a “Jewish state,� he endangers the broader Jewish community. That includes those moderate Jews who anticipated this extremist behavior when in May 1948 Truman overruled the strategic objections of Secretary of State George C. Marshall and enabled this fanaticism by extending nation-state recognition.

Small in numbers but large in ambition, this extremist enclave had no choice but to wage war by way of deception. The most insidious deceit was targeted, from within, at its purported ally to induce the U.S. military to lead an invasion of Iraq for its Greater Israel strategy.

Absent an Israeli strategy able to sustain serial crises, a long-deceived public will awaken to the common source of the fixed intelligence that led us into the last war—and now seeks to induce the next. As Americans awaken to how this duplicity proceeds in plain sight, they will see for themselves who and why.

That knowledge is the threat that Tel Aviv most fears. As the facts become known, Israeli legitimacy will no longer be an issue. The only issue will be how best to dis-arm these extremists and how to hold accountable those lawmakers who enable this ongoing treason. Goldstone and Gaza

November 06, 2009 "New York Times" -- Published: November 5, 2009 -- Judge Richard Goldstone and the United Nations fact-finding mission on the Gaza conflict have issued a report about Gaza that is strongly critical of both Israel and Hamas for their violations of human rights. On Wednesday, a special meeting of the U.N. General Assembly began a debate on whether to refer the report to the Security Council.

In January 2009 rudimentary rockets had been launched from Gaza toward nearby Jewish communities, and Israel had wreaked havoc with bombs, missiles, and ground invading forces. Judge Goldstone’s claim is that they are both guilty of “crimes against humanity.� Predictably, both the accused parties have denounced the report as biased and inaccurate.

It is good to remember that Judge Goldstone, from South Africa, is one of the world’s most widely respected jurists, with an impeccable record of wisdom, honesty and integrity. He is a devout Jew and has long been known as a fervent defender of Israel’s right to peace and security.

In April 2008 I personally visited Sderot and Ashkelon, Israeli communities near enough to have been hit by rockets fired from within Gaza. While there, I condemned these indiscriminate attacks on civilians as acts of terrorism, and I consider their condemnation by Judge Goldstone to be justified.

A year later, after the Israeli attack on Gaza, I was able to examine the damage done to the small and heavily populated area, surrounded by an impenetrable wall, with its gates tightly controlled. Knowing of the ability of Israeli forces, often using U.S. weapons, to strike targets with pinpoint accuracy, it was difficult to understand or explain the destruction of hospitals, schools, prisons, United Nations facilities, small factories and repair shops, agricultural processing plants and almost 40,000 homes.

The Goldstone committee examined closely the cause of deaths of the 1,387 Palestinians who perished, and the degree of damage to the various areas. The conclusion was that the civilian areas were targeted and the devastation was deliberate. Again, the criticism of Israel in the Goldstone report is justified.

He has called on the United States, Israel and others who dispute the accuracy of the report to conduct an independent investigation of their own. Hamas leaders have announced that their investigation is under way, but Israel has rejected Judge Goldstone’s request.

Putting this dispute aside, it is important to examine present circumstances and the need to prevent further suffering. The rocket fire from Gaza is now being severely restrained, perhaps because of the certainty of Israeli retaliation, but the punishment of the 1.5 million Palestinian inhabitants of Gaza continues. Now and for the past 10 months, Israel has not permitted cement, lumber, panes of glass, or other building materials to pass their entry points into Gaza. Several hundred thousand homeless people suffered through last winter in a few tents, under plastic sheets, or huddled in caves dug into the debris of their former homes. The weather was warmer when I was there several months later, but the description of suffering through the winter cold was heartbreaking.

Another winter is now approaching, and neither the Israelis nor the international community has taken steps to alleviate the Gazans’ plight. United Nations agencies and leaders in the European community have offered to provide an avenue of channeling funds and building materials directly to the people in need, completely bypassing the Hamas political leaders. These officials, both in Gaza and in Damascus, have assured me that they would accept this arrangement.

There would be no chance for the misuse of such assistance for weapons, military fortifications, or other non-humanitarian purposes.

I was informed recently by King Abdullah of Saudi Arabia that he has pledged $1 billion, and other Arab leaders have added an additional $300 million for this purpose. There is little doubt that other nations would also be generous.

Without ascribing blame to either of the disputing parties, it is imperative that the United States and the international community take steps to assure that the rebuilding of Gaza be commenced, and without delay. The cries of homeless and freezing people demand relief.
